This pandemic-era law is sticking around in California — and restaurants are relieved

California restaurants and bars are getting a longer runway to keep a popular pandemic-era revenue stream alive after the state officially extended its cocktails-to-go program through 2026. The law helps boost alcohol sales with the ever-increasing to-go orders as consumers dine out less nationwide.

A pandemic policy turned long-term support

Originally introduced during COVID-19, cocktails-to-go quickly became a lifeline for struggling hospitality businesses. Lawmakers later moved to preserve the program, with Gov. Gavin Newsom signing legislation to extend it through December 31, 2026. 

The extension allows eligible restaurants, bars, and similar establishments to continue selling alcoholic beverages for off-site consumption alongside takeout orders.

Industry groups say the measure has played a critical role in stabilizing businesses still recovering from pandemic-era losses, offering an additional stream of revenue at a time when costs remain high.

How the law works

While the program expands flexibility, it comes with strict rules:

• Cocktails must be sold with a meal
• Limited to two drinks per order
• Drinks must be sealed in secure containers
• In-person pickup only — delivery is not allowed 

There are also limits on alcohol content and packaging requirements designed to prevent immediate consumption and comply with open container laws.

A continued boost for restaurants

For many operators, cocktails-to-go have become a permanent part of the business model. Industry data shows a significant share of takeout customers are willing to add alcoholic beverages to their orders, helping boost average check sizes. 

Restaurant groups have consistently supported the extension, calling it a “critical lifeline” that helps offset rising labor, rent, and food costs.

What happens after 2026?

The law is currently set to expire at the end of 2026, though discussions are ongoing about whether to make cocktails-to-go permanent in California. 

For now, businesses have several more years to take advantage of the program — and many are betting it’s here to stay in some form.
